Please read these Terms of Use ("Terms") carefully before using Netutilus: Network Utility ("the App") developed by Poteam ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Netutilus, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Netutilus on any Apple-branded device that you own or control, as permitted by the Apple App Store Terms of Service. This license does not allow you to distribute, modify, reverse-engineer, or create derivative works based on the App.

3. Description of Service

Netutilus is a macOS network diagnostic utility that provides tools including, but not limited to, ping, traceroute, DNS lookup, port scanning, and network interface information. The App is designed as a local utility and all network diagnostics are performed directly from your device.

4. Acceptable Use

You agree to use Netutilus only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App to perform network scans or diagnostics on networks, systems, or devices you do not own or have explicit authorization to test.
  • Use the App in any way that violates applicable local, national, or international law or regulation.
  • Use the App to attempt unauthorized access to any network, server, or system.
  • Use the App in a manner that could damage, disable, or impair any network or system.

You are solely responsible for ensuring that your use of the App's network diagnostic features complies with all applicable laws and regulations, and that you have proper authorization to perform diagnostics on any target hosts or networks.

5. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Poteam. The App is protected by copyright, trademark, and other applicable laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

6. Disclaimer of Warranties

Netutilus is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the App's reliability, accuracy, availability, or fitness for a particular purpose. Network diagnostic results may vary depending on network conditions, configurations, and other factors beyond our control. We do not guarantee the accuracy or completeness of any diagnostic results provided by the App.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Poteam shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the App.
  • Any network diagnostics performed using the App.
  • Any unauthorized access to or alteration of your data.
  • Any other matter relating to the App.

8. Third-Party Networks and Services

Netutilus performs diagnostics by sending standard network packets to hosts and services specified by you. We are not responsible for any third-party networks, services, or systems that you interact with through the App. Your interactions with third-party networks are solely between you and the respective third party.

9. Updates and Modifications

We reserve the right to modify, update, or discontinue the App at any time without prior notice. We may also update these Terms from time to time. Any changes will be effective immediately upon posting the updated Terms. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your license to use the App will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.
